This paper had as its starting point the existence of a pedagogical project that is still carried out daily with children riding their bicycles in Praça da República, located in the city of São Paulo. The method employs two internet social networks, Instagram and WhatsApp, with which it is possible to generate images and conduct interviews and brief dialogues. It aims to answer some questions: What city within a city is manifested in the experiences of children riding their bikes in (...) the Republic Square? What can we deduce from this practice what occurs or is possible to occur within a public space when we consider the presence of children, as, for example, in the Motoca na Praça project, when children actually officially occupy the square? Is there a production of space, even if ephemeral, that results from the presence of children? Perhaps a simpler question is, where is childhood located in this square? Historically is it possible to see it produced, present or absent, in the transformations of any given space by the presence of children? We rely on the philosopher Henri Lefebvre’s notion of the production of social space to hypothesize what would follow from the production of urban spaces that were transformed by the presence of children of all ages, from infancy on. No contexto neoliberal, no qual imperam a cultura da auditoria e da meritocracia, a lógica do empreender-se a si mesmo e a visão de educação como mercadoria, convivemos com o mal-estar dentro e fora da docência. Nesse panorama, este artigo objetiva problematizar a racionalidade neoliberal vigente dentro e fora das salas de aula. Trata-se de uma análise discursiva de depoimentos de três professores de ensino superior sobre o cuidado (de si), a partir de ferramentas teórico-analíticas de Foucault, com o intuito (...) de apontar em que medida os efeitos de sentido da responsabilização do sujeito por suas escolhas emergem em seus depoimentos. A análise remete-nos à presença dos modos de objetivação, por exemplo, às técnicas (pós-)modernas de gestão do tempo, qualidade muito apreciada no contexto neoliberal, na incessante busca da produtividade, da eficácia/eficiência e do empreendedorismo de si. Porém, a análise também sinalizou o desejo de cuidar(-se) mais e melhor, sendo a boa gestão do tempo vista pelos professores como uma das formas de realizá-lo. Embora tais estratégias estejam permeadas de/por técnicas neoliberais de governamentalidade, visando, de diversas maneiras, a conduzir nossas condutas, não objetivamos criticá-las, mas apenas descortinar de que maneira o uso de técnicas de gestão do tempo, paradoxalmente necessárias para (con/sobre)viver no mundo contemporâneo, nos conduzem de forma sub-reptícia. Nesse contexto, o cuidado de si, como entendido por Michel Foucault, no sentido de invenção de novas formas de vida poderia emergir como possibilidade de produzir contracondutas, apostando na relação consigo como uma alternativa, uma forma de resistência diante do poder, cuidado este, por vezes, sufocado pela competitividade generalizada que nos governa. Este artigo estabelece a relação entre apercepção transcendental e identidade, existência e percepção, e procura com isso mostrar que, embora esteja na base da estrutura cognitiva humana, a autoconsciência não elabora conhecimento.

O texto é dividido em duas etapas. Na primeira, constituída de três partes, são considerados os principais conceitos da Doutrina do direito de Kant, numa abordagem abrangente relativa: ao problema das relações entre o direito natural e o direito positivo, problema estreitamente conectado com o das relações entre estado de natureza e estado civil, direito privado e direito público; à doutrina da propriedade e sua conexão com o direito político. Ao tratar do direito nos seus diversos tipos tenciona-se indicar a (...) razão prática como pano de fundo da Doutrina. Numa segunda etapa, concernente à última parte, a consideração da presença da razão prática no direito é colocada perante algumas especificidades da filosofia da história de Kant, com o intento de estabelecer a possível relação entre a Rechtslehre e aquela filosofia. Gideon Rosen (2014) has drawn our attention to cases of duress of a particularly interesting sort: the person's ‘mind is not flooded with pain or fear’, she knows exactly what she is doing, and she makes a clear-headed choice to act in, as Rosen says, ‘awful ways’. The explanation of why we excuse such actions cannot be that the action was not voluntary. In addition, although some duress cases could also be viewed as necessity cases and thus as justified, Rosen (...) wisely sets aside that complicating factor by zeroing in on those cases where the action clearly is not justified. So why do we excuse in these cases, where the action is not justified and the agent acted voluntarily?Rosen thinks the key lies in the ‘ill will’ condition, ‘the idea that an act is blameworthy only if it manifests insufficient concern or regard for those affected’. He says this is relatively uncontroversial; much of my paper is taken up with calling the ‘ill will’ condition into question. I also take issue with Rosen on just how justifications and excuses differ. I argue in favour of understanding justifications (in a context where we are asking how justifications and excuses differ) as not requiring truth, but only reasonable belief. (shrink)

Informed consent is recognized as a primary ethical requirement to conduct research involving humans. In the investigations with the use of human biological material, informed consent (IC) assumes a differentiated condition on account of the many future possibilities. This work presents suitable alternatives for IC regarding the storage and use of human biological material in research, according to new Brazilian regulations. Both norms – Resolution 441/11 of the National Health Council, approved on 12 May 2011, and Ordinance 2.201 (NATIONAL GUIDELINES (...) FOR BIOREPOSITORIES AND BIOBANKS OF HUMAN BIOLOGICAL MATERIAL FOR RESEARCH PURPOSE) of the Brazil Ministry of Health, approved on 14 September 2011 – state that the consent of subjects for the collection, storage and use of samples stored in Biobanks is necessarily established by means of a Free and Informed Consent Form (ICF). In order to obtain individual and formal statements, this form should contain the following two mutually exclusive options: an explanation about the use of the stored material in each research study, and the need for new consent or the waiver thereof when the material is used for a new study. On the other hand, ICF suitable for Biorepositories must be exclusive and related to specific research. Although Brazilian and international regulations identify the main aspects to be included in the IC, efforts are still necessary to improve the consent process, so that the document will become a bond of trust between subject and researcher. A new Clinical Ethics Advisory Group was created to contribute to NHS Trust policies and guidelines in response to ethical issues arising from the COVID-19 pandemic. An ethical analysis framework used in medical education, the CoRE-Values Compass and Grid, was adapted to form a step-wise ‘ABC’ decision-making process. CEAG members found the framework simple to understand and use and the model facilitated time-efficient decisions that were explicitly justifiable on moral, ethical, professional and legal grounds. The adapted CoRE-Values framework might help (...) facilitate decision-making processes for similar new clinical ethics advisory or support committees. (shrink)

The emphasis on duly in Kant's ethics is widely held to constitute a defect. Marcia W. Nursing practice as bricoleur activity: a concept explored The debates concerning the nature of nursing practice are often rooted in tensions between artistic, scientific and magical/mythical practice. It is within this context that the case is argued for considering that nursing practice involves bricoleur activity. This stance, which is derived from the work of Levi‐Strauss, conceives elements of nursing practice as an embodied, bricoleur practice where practitioners draw on the ‘shards and fragments’ of the situation‐at‐hand to resolve the needs of (...) the individual patient for whom they care. This conceptualisation of nursing practice will be analysed with a particular emphasis on its implication for nursing epistemology, pedagogy and praxis. The evidence to support this argument is drawn from empirical work that investigated nurses’ use of intuition, the work of Levi‐Strauss, and issues in nursing epistemology and ontology. The paper itself is written from the perspective of a bricoleur who uses ‘bits and pieces’ from the domains of nursing, philosophy, psychology, education, sociology and anthropology. (shrink)

The impact of neoliberal reforms of education systems on the work of teachers and school leaders, particularly in relation to high-stakes accountability frameworks, has been extensively studied in recent decades. One significant aspect of neoliberal schooling is the emergence of quasi-autonomous public schools (such as Academies in England, Charter Schools in the USA and Independent Public Schools in Australia), characterised by heterarchical governance models, the promotion of entrepreneurial leadership cultures, and the promotion of a discourse of pursuing educational equity by (...) means of ‘achievement for all’. This paper explores the emergence of a mode of teacher professionalism characteristic of these quasi-autonomous schools, and conceptualises this as being ‘neo-performative’. The neo-performative profession is shaped by the shift in the focus of the regulation and management of schools from ‘governing to governance’, and the consequential rise of the ‘responsibilised profession’, and marked by the emergence of an entrepreneurial model of school leadership. The paper argues that this new conceptualisation of teacher professionalism requires further, more focused, empirical study in order to explore how neoperformative teachers and school leaders articulate their vision of educational equity and social justice, and how they enact this vision in an increasingly intensified high-stakes accountability culture. When successful and ethical managers are alerted to possible organizational wrongdoing, they take corrective action before the problems become crises. However, recent research [e.g., Rynes et al. (2007, Academy of Management Journal50(5), 987–1008)] indicates that many organizations fail to implement evidence-based practices (i.e., practices that are consistent with research findings), in many aspects of human resource management. In this paper, we draw from years of research on whistle-blowing by social scientists and legal scholars and offer concrete suggestions to managers who (...) are interested in encouraging internal reporting of problems requiring attention, and to observers of questionable activity who are considering reporting it. We also identify ways that research suggests policy-makers can have a more positive influence. We hope that these suggestions will help foster evidence-based practice regarding whistle-blowing. A literatura negra feminina é pouco utilizada no contexto escolar da educação básica. Entretanto, ela pode provocar reflexões acerca das desigualdades sociais e do papel da mulher negra na sociedade brasileira. Assim, este artigo objetiva refletir acerca da relevância da literatura de Conceição Evaristo no panorama social e acadêmico, pois seus contos abordam a representação do feminino a partir de mulheres negras e denunciam as hierarquias quanto aos papéis de gênero em uma sociedade marcada pelo patriarcalismo. Portanto, tomaremos como aportes (...) teóricos a Lei 11.645/08 e as reflexões de estudiosos como: bell hooks (2017) com a educação transgressora; Kabengele Munanga (2008) com a problematização do racismo em sala de aula; Miriam Alves (2011) com o rompimento de estereótipos; Djamila Ribeiro (2021) com o lugar de fala para romper com o silenciamento, entre outros. A metodologia é um relato de experiência com roda de conversa sobre o conto “Isaltina Campo Belo”, de Conceição Evaristo (2016), inserido no livro Insubmissas lágrimas de mulheres, com a 1ª série do ensino médio em uma escola pública. Logo, a atividade de leitura com literatura negra feminina, no contexto educacional, pode levar o estudante à reflexão de inclusão ou exclusão no panorama literário afro-brasileiro e africano. Recent studies show that returning global health trainees often report having felt inadequately prepared to deal with ethical dilemmas they encountered during outreach clinical work. While global health training guidelines emphasize the importance of developing ethical and cultural competencies before embarking on fieldwork, their practical implementation is often lacking and consists mainly of recommendations regarding professional behavior and discussions of case studies. Evidence suggests that one of the most effective ways to teach certain skills in global health, including ethical and (...) cultural competencies, is through service learning. This approach combines community service with experiential learning. Unfortunately, this approach to global health ethics training is often unattainable due to a lack of supervision and resources available at host locations. This often means that trainees enter global health initiatives unprepared to deal with ethical dilemmas, which has the potential for adverse consequences for patients and host institutions, thus contributing to growing concerns about exploitation and “medical tourism.” From an educational perspective, exposure alone to such ethical dilemmas does not contribute to learning, due to lack of proper guidance. We propose that the tension between the benefits of service learning on the one hand and the respect for patients’ rights and well-being on the other could be resolved by the application of a simulation-based approach to global health ethics education. The distinction between justifications and excuses is a familiar one to most of us who work either in moral philosophy or legal philosophy. But exactly how it should be understood is a matter of considerable disagreement. My aim in this paper is, first, to sort out the differences and try to figure out what underlying disagreements account for them. I give particular attention to the following question: Does a person who acts on a reasonable but mistaken belief have a justification, (...) or only an excuse? One disagreement I highlight concerns the extent to which justification is primarily about agents rather than about actions. Those who think, as I do, of “His action, X, was justified” as “He was justified in doing X” are far more likely to allow that justification requires reasonable belief and does not require truth, than are those who think of “His action, X, was justified” as “Although actions of this type usually are prohibited, X is in these circumstances in fact permissible.” In addition to sorting out the differences and tracing them to some underlying disagreements, I defend the reasonable belief view of justification against some objections, and argue that, whether or not we continue to use the term “justified” in a way that does not require truth, we need the concept. Contrary to the claims of some who reject the reasonable belief view of justification, justification thus understood does not reduce to excuse. (shrink)

Marcia Cavell draws on philosophy, psychoanalysis, and the sciences of the mind in a fascinating and original investigation of human subjectivity. A "subject" is a creature, we may say, who recognizes herself as an "I," taking in the world from a subjective perspective; an agent, doing things for reasons, sometimes self-reflective, and able to assume responsibility for herself and some of her actions. If this is an ideal, how does a person become a subject, and what might stand in (...) the way? One of Marcia Cavell's guiding premises is that philosophical investigation into the specifically human way of being in the world cannot separate itself from investigations of a more empirical sort. Cavell brings together for the first time reflections in philosophy, findings in neuroscience, studies in infant development, psychoanalytic theory, and clinical vignettes from her own psychoanalytic practice. In this article, we describe the social and economic changes that have contributed to contemporary problems of work—family conflict, gender inequality, and risks to children's healthy development. We draw on feminist welfare state scholarship to outline an institutional arrangement that would support an earner—carer society—a social arrangement in which women and men engage symmetrically in paid work and unpaid caregiving and where young children have ample time with their parents. We present a blueprint for work—family reconciliation policies in three areas—paid (...) family-leave provisions, working-time regulations, and early childhood education and care—and we identify key policy design principles. We describe and assess these work—family reconciliation policies as they operate in six European countries widely considered to be policy exemplars: Denmark, Finland, Norway, Sweden, Belgium, and France. A Philosophical Examination of Christian Voluntarism," Anastasia Phillippa Scrutton has offered a thoughtful contribution to the philosophical literature regarding depression and freedom of the will. Her analysis provides a careful and well-organized review of the position, prevalent in some Christian literature, that depression is within the individual's control and is thus a sin.
